1. Acceptance of Terms

By accessing, registering for, or using Linguametric ("the Service", "we", "us", or "our"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the Service.

By using the Service, you represent that you are at least 18 years of age, or if you are under 18, that you have obtained parental or guardian consent to use this Service.

By accepting these Terms, you provide your explicit and informed consent for us to collect, process, store, and analyze all data you submit to the Service, including but not limited to voice recordings, text inputs, personal information, and usage data. This consent is a prerequisite for using the Service.

2. Description of Service

Linguametric is an AI-powered platform designed to provide English speaking practice and assessment. The Service analyzes audio recordings submitted by users and generates automated feedback, scores, and recommendations using artificial intelligence technologies.

Access to certain features of the Service may require a valid credit balance or payment. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. User Accounts & Responsibilities

• You are solely responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized access to your account.
• We reserve the right to suspend, disable, or terminate any account at our sole discretion, with or without cause, and with or without notice.
• You agree not to use the Service for any unlawful purpose or in violation of these Terms.

4. Data Processing & Consent

Important: All data described above WILL be processed. By continuing to use the Service, you acknowledge and agree to this processing. If you do not consent, you must immediately stop using the Service.

5. Data Anonymization & Reports

While we process your full data internally for service functionality, any assessment reports or outputs generated by the Service may be anonymized or pseudonymized. Specifically:

• User full names may be partially masked or abbreviated in certain report outputs (e.g., "John D." instead of "John Doe").
• Internally, we retain full user information as provided during registration.
• Aggregated, anonymized data may be used for research, analytics, product improvement, or shared with third parties without identifying individuals.

6. Intellectual Property

By submitting content (including audio recordings) to the Service, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of providing and improving the Service.

All trademarks, logos, service marks, and content provided by Linguametric are the property of Linguametric or its licensors. You may not use any of these without prior written consent.

7. Cookies & Tracking Technologies

We use cookies, local storage, and similar tracking technologies to operate and improve the Service. By accepting our cookie consent banner on public pages, or by using the authenticated dashboard areas, you agree to the use of these technologies.

For authenticated users (Institution, Admin dashboards), analytics tracking is enabled as part of the Terms of Service acceptance during registration, regardless of cookie consent preferences on public pages.

8. Payment & Credits

• Access to the Service may require purchase of credit packs or one-time charges.
• All payments are processed through third-party payment processors. We do not store your complete payment card details.
• All payments are non-refundable unless otherwise required by applicable law or at our sole discretion.
• Credits have no cash value and are non-transferable.
• We reserve the right to modify pricing and credit allocation at any time. Continued use after pricing changes constitutes acceptance.

You agree to indemnify, defend, and hold harmless Linguametric, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

11. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration or in the courts of Istanbul, Turkey. You waive any objection to venue in these jurisdictions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.

It is your responsibility to review these Terms periodically for updates.

13. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
